1. General Provisions

These general conditions of sale (hereinafter, "General Conditions") apply to all sales of products (hereinafter, "Products" or "Product") purchased through the website www.viziovirtu.com (hereinafter, "Site").

The use of the distance selling service described in these General Conditions is reserved exclusively for consumers (hereinafter referred to as "Customers" or the "Customer"), understood as natural persons acting for purposes unrelated to their commercial, entrepreneurial or professional activity.

The Customer must carefully read the General Conditions that have been made available to him on the Site, in order to allow their storage and reproduction by the Customer pursuant to Article 12 of Legislative Decree No. 70 of 9 April 2003.

Contracts concluded with 4doni Srl through the Site are governed by Italian law and, in particular, by Legislative Decree 6 September 2005, no. 206 ("Consumer Code") and Legislative Decree 9 April 2003, no. 70 (hereinafter, "Ecommerce Decree").

In order to validly conclude the contract, the Client must be of legal age (18 years) and have the legal capacity to act, which he or she declares to possess. Any costs for connecting to the Site via the Internet, including telephone costs, shall be borne exclusively by the Customer, according to the rates applied by the operator selected by the Customer.

3. Intellectual property rights

The contents of the Site such as, by way of example, the works, images, photographs, dialogues, music, sounds and videos, documents, drawings, figures, logos and any other material, in any format, published on www.viziovirtu. com, including menus, web pages, graphics, colours, schemes, tools, fonts and website design, diagrams, layouts, methods, processes, which are part of www.viziovirtu.com, are protected by copyright and any other intellectual property rights of the Seller and other right holders.

Reproduction, in whole or in part, in any form whatsoever, of www.viziovirtu.com of its contents is prohibited without the express written consent of the Seller and, where necessary, of other rights holders.

4. Brands

Viziovirtù and its logo present on the website are registered trademarks and are used within www.viziovirtu.com for the purpose of distinguishing, describing and advertising the products on sale. Any use of these trademarks that is not in accordance with the law and unauthorized, is prohibited and carries serious legal consequences. It is not permitted in any way whatsoever to use these marks and any other distinctive sign present on www.viziovirtu.com to take unfair advantage of the distinctive character or reputation of these marks or in such a way as to damage them.

5. Information on Products

Information on Products that can be sold at a distance is available on the website. This information is provided in accordance with Articles 52 and 53 of the Consumer Code.

6. Price

The prices of the products are inclusive of all taxes and duties, except for any customs duties for international sales that are charged to the customer. Customs duties, in case of exercise of the right of withdrawal or rejection of the package by the recipient, will be borne by the customer and in no case of VizioVirtù. All prices are in Euro. Shipping costs are charged to the customer.

7. Ordering Products

The essential characteristics and prices of the Products are reported in the offer related to each Product. The contract between VizioVirtù and Customer is concluded exclusively through the Internet by accessing the address of this site, where, following the procedures indicated, the Customer will formalize the purchase order of the goods offered for sale.

For the purchase of the Products the Customer will have to fill in online and send to VizioVirtù the order form in electronic format, following the instructions contained in the Site. The Customer will have to put the Product in the "cart", in particular, the Customer will have the right to change the quantity of the Products he intends to purchase, adding or removing one or more Products from the "cart".

After you have read the General Terms and Conditions, you will have to select the desired payment method and choose the option "Confirm order".

By sending the order, which constitutes a contractual proposal, the Customer acknowledges and declares that he/she has read all the information provided to him/her during the purchase process and accepts the General Conditions in full.

8. Methods of payment and reimbursement

The Customer may pay the price of the Products and the relevant delivery costs by Credit Card and PayPal.

We accept payment by all major credit cards, including: Visa, MasterCard and American Express.

Paypal: once the order has been confirmed, the Customer shall be redirected to the PayPal website where he/she can make the payment with his/her account or using a credit card or in any case according to the methods accepted by PayPal and in compliance with its conditions.

If, for any reason whatsoever, it proves impossible to debit the amounts owed by the Customer, the sale process is automatically cancelled and the sale automatically cancelled.

Any reimbursement to the Customer, if he is entitled to it, will be credited by bank transfer, at the latest within 30 days from the date on which the Seller became aware of the cause generating the right to reimbursement.

9. Confirmation of order receipt

In accordance with the provisions of Article 53 of the Consumer Code, the Customer shall receive, at the time of execution of the contract, by e-mail, confirmation of receipt of the purchase order sent by the Customer, containing the order number, the shipping data, the list of products ordered with their essential characteristics and the total price, including shipping costs.

10. Transport and delivery

The Products purchased on the Site will be delivered to the address indicated by the Customer. VizioVirtù will deliver the ordered products through the courier DHL or, in cases where it is necessary, through other couriers. Except in cases of force majeure or unforeseeable circumstances, the ordered Products will be delivered in Italy within a period of 5 (five) working days from the day after the day in which VizioVirtù has confirmed the order to the Customer through an order confirmation e-mail.

Delivery times may vary depending on the country of destination and other factors beyond the Seller's direct control.

Shipments outside the EEC are accompanied by an invoice, as required by current regulations. The Customer is invited to check the import conditions in his country before placing an order. You may incur unforeseen additional charges (taxes and customs duties) that cannot be estimated. If you wish to ship to a country outside of the EEC, we recommend that you inquire about the restrictions on importing food products into your destination country before confirming your order.

For all countries that subject consignments to the payment of customs duties, the payment of such duties and the verification of the amount of customs duties with the competent bodies of the receiving country is the responsibility of the recipient.

The cost of shipping is calculated according to the weight of the goods in the basket and the country of destination, using the rate that the carrier applies based on the volume of operations carried out, so it is not possible to indicate this cost until the choice is complete.

For the delivery of the goods, the presence of the Customer or of a person appointed by him/her at the recipient's address indicated in the order is required. Upon delivery of the goods by the Courier, the Customer is required to check that the number of packages delivered corresponds to that indicated in the transport document and that the package is intact or not altered. Any damage to the package and/or the Products or the mismatch in the number of packages must be immediately notified by means of a written control reservation on the Courier's proof of delivery. Once the Courier's document has been signed, the Customer may not raise any objection regarding the external characteristics of the package delivered.

11. Right of withdrawal

The Customer has the right to withdraw from this contract, without penalty, within 14 (fourteen) working days from the date of receipt of the products ordered, for any reason whatsoever, without the need to provide explanations and without penalty. The Customer may exercise the right of withdrawal within the aforementioned term by sending an explicit declaration of withdrawal by e-mail to info@viziovirtu.com.

In order for the right of withdrawal to be validly exercised, if the shipment or delivery of the ordered products has already taken place, the Customer will be required to return them to VizioVirtù within the peremptory term of 14 (fourteen) working days from receipt of the products.

It is understood that the risks and costs of transport relating to the return of the products to the Seller shall be borne by the Customer.

In order for the right of withdrawal to be validly exercised, the products must be delivered, or in any case sent to the Seller, intact (without any sign of opening, wear, abrasion, scratch, deformation, etc.), complete with all their elements and accessories, accompanied by the original packaging and packing. Failing this, the Customer shall not be entitled to a refund of the amount paid. The Seller shall take delivery of the returned products, reserving the right to check that they have been returned in the conditions described above.

If the verification of the returned products has a positive outcome and the right of withdrawal has been validly exercised within the terms and according to the procedures provided, the Seller will refund the Customer the entire amount paid for the purchase of the products free of charge, not including shipping costs previously incurred by the Customer for the purchase itself, as soon as possible and in any case no later than 30 (thirty) days from the date on which the Seller became aware of the exercise of the right of withdrawal by the Customer.

The aforementioned reimbursement shall be made by bank transfer in favour of the Customer. It will be the Customer's duty to communicate to the Seller, by sending to the e-mail address info@viziovirtu.com, the bank details to make the bank transfer in his favour and to put VizioVirtù in the condition to be able to return the amount due.

12. Errors

The information relating to the Products provided on the Site is constantly updated. However, it is not possible to guarantee the complete absence of errors.

VizioVirtù reserves the right to correct errors, inaccuracies or omissions even after an order has been placed and also to change or update information at any time without prior notice.

13. Limitations of liability

VizioVirtù does not assume any responsibility for inefficiencies due to force majeure or for inefficiencies or malfunctions related to the use of the Internet outside of its own control or that of its subcontractors.

VizioVirtù shall not be liable to the Customer, except in cases of fraud or gross negligence, and shall not be liable for damages, losses and costs incurred by the Customer as a result of the non-execution of the contract for reasons not attributable to him, the Customer being entitled only to a full refund of the price paid.

VizioVirtù assumes no responsibility for any fraudulent or illegal use that may be made by third parties of credit cards at the time of payment of products purchased if it proves to have taken all precautions applicable at the time of the transaction.

VizioVirtù will not be liable in case of total or partial non-fulfilment of its obligations under this contract if such non-fulfilment is caused by unforeseeable events and/or natural events beyond its reasonable control, including, but not limited to, catastrophic natural events, lack of electricity, general strike of public and/or private workers, strikes and/or restrictions on courier routes and connections.

14. Validity of clauses

The present conditions do not prejudice the rights attributed by Italian law to the Consumer who acts as a consumer or the rights guaranteed to him by the mandatory provisions of the system to which he is subject.

In the event that a clause or part of a clause of these general terms and conditions should be deemed invalid because it conflicts with or is contrary to a rule of law, all other clauses of this agreement or parts of the same clause shall remain in full force and effect.

15. Applicable law and jurisdiction

The General Terms and Conditions of Sale are governed by Italian law and in particular by Legislative Decree No. 206 of 6 September 2005, as amended and supplemented, on the Consumer Code, with specific reference to the regulations on distance contracts and by Legislative Decree No. 70 of 9 April 2003 on certain aspects of e-commerce.

For disputes arising from the interpretation, validity and/or execution of these General Conditions, should the Parties intend to refer the matter to the ordinary Judicial Authorities, the mandatory territorial jurisdiction shall be that of the Court of Venice.
